Information for Employers and Individuals covered by Self-Funded Plans

Consumers are sometimes contacting insurers and learning that their insurance doesn’t cover autism treatments under the law. Usually this is because the employer has a self-funded plan. Self-funded plans, sometimes referred to as ERISA plans, are regulated by federal law. This includes many of the State’s largest employers. ERISA plans are not subject to State laws and not required to follow specific mandates.

However some self-funded employers follow state mandates as a matter of course, and most are willing to consider these on a case-by-case basis.

Employees should check with their companies to find out if their insurance plan is self-funded. If so, we have a number of resources to helping you advocate with your company to adopt the law. We are also happy to speak and/or meet with employers directly.
